How much Air Malta compensation can I get for a delayed or cancelled flight?

The amount of compensation is determined by the distance of your flight and provided per passenger:

 

  • For flights shorter than 1,500 km, the compensation is £220.

  • For flights between 1,500 and 3,500 km, the compensation is £350.

  • For flights of over 1,500 kilometres within the EU, the compensation is also £350.

  • For flights of over 3,500 kilometres outside of the EU, the compensation is £520 —but if your flight was delayed by fewer than 4 hours, the total amount might be reduced by 50%.

I was flying with Air Malta to a non-EU country. Can I still claim compensation? 

You certainly can. Considering that Air Malta's headquarters are in Malta, an EU country, the EU flight compensation regulations apply to all flights operated by the airline. Even if you were on an Air Malta flight to or from Algiers, you are still eligible to file a compensation claim for a flight disruption.

However, if your flight is operated by a non-EU carrier, as mentioned in the table below, conditions may differ.

Extraordinary circumstances — can Air Malta deny me compensation?

Air Malta may refuse to compensate passengers if the disruption was caused by extraordinary circumstances, such as a third party or force majeure. Air Malta is not required to pay flight compensation when they are not at fault for the delay or cancellation.

Among the most common extraordinary circumstances are:

 

  • Bad weather conditions, such as thick fog, heavy rain, or thunderstorms.

  • A strike, most often specifically within the aviation industry (for example, a strike of air traffic control workers at a specific airport).

    However, a strike of the airline's crew is not considered an extraordinary circumstance!

  • Political circumstances, such as a terrorist attack or general security risk due to political unrest.

  • Natural disasters, including volcanic eruptions and hurricanes.

  • A collision between the aircraft and birds or other foreign objects.

  • An ill or unruly passenger.

  • Flight delays caused by the airport staff, such as extraordinarily long queues to security checks.

 

In some cases, however, airlines may claim that extraordinary circumstances occurred when they did not. Airlines do this to keep from paying the proper compensation to passengers.

 

How long do I have to claim my Air Malta compensation and refund?

As a result, claims may be made under the legislation of the country of departure or destination.
