European air passenger rights — protection in case of a delayed or cancelled ITA Airways flight
European Regulation (EC) No. 261/2004 protects passengers in the event of a cancelled or significantly delayed flight.
- If your ITA flight was cancelled fewer than 14 days prior to departure, you might be entitled to compensation. Additionally, if your ITA Airways flight was cancelled and you were not offered any alternative flights by the airline or did not take the offer, you might also be entitled to a refund.
- If your ITA Airways flight is delayed by at least 3 hours, you are entitled to compensation of up to €600 as both the British and EU regulations state.
Although the United Kingdom is no longer a member of the European Union, the regulation has been adopted into British law after Brexit as 'The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019’. This means British passengers retain the air passenger rights they enjoyed while being part of the EU.
I am travelling outside of the UK/EU with ITA Airways. Am I still eligible for compensation?
Yes! Because ITA Airways is an airline headquartered in Europe, the European regulations apply to all of its flights, including inbound and outbound flights to non-EU destinations.
This means you are protected in the event of a cancelled or delayed ITA flight even if you were flying with ITA Airways to a non-EU country, such as the United States.
However, if you are flying to a non-EU destination with a non-British/non-European airline, the European regulations cover only your flights from the UK or fromEurope. See the table below for more info.

Extraordinary circumstances — can ITA Airways deny me compensation?
Unfortunately, passengers are still too often denied compensation and refunds. You should be aware, however, that there are only a few exceptional cases in which the airline can rightfully deny your claim. We call these extraordinary circumstances, which usually happen when a third party or an unforeseen incident, instead of the airline, is to blame for the delay or cancellation.
Some examples of the most common extraordinary circumstances are bad weather conditions (eg. dense fog, strong winds, or heavy rain), natural disasters, such as earthquakes, wildfires, and volcanic eruptions, a delay or cancellation caused by an ill or unruly passenger, and a strike caused by workers within the aviation industry not related to the airline (eg. baggage handlers).
However, keep in mind that an ITA Airways strike caused by workers within the airline (eg. pilots, flight attendants) are NOT considered an extraordinary circumstance and you can claim compensation!

About ITA Airways
Alitalia, the national Italian airline and the go-to choice of popes, ceased its operations in October 2021. After years of financial problems, the Italian government decided to shut the company down and — with an agreement from the EU — open a new, debt-free airline.
ITA (Italia Trasporto Aereo) officially commenced operations on the 15th of October 2021. The new Italian airline is significantly downsized compared to Alitalia. The airline currently operates only part of the routes previously operated by Alitalia, has 52 jets (less than half of Alitalia's fleet) and hires 2,800 employees (about a fourth of Alitalia's workforce).
However, the management of ITA Airways already has plans to expand the airline’s operations. New routes are planned for early spring 2022, including two new destinations in the United States (Los Angeles and Washington, D.C.).
Interestingly, despite the fact that ITA has purchased rights to the Alitalia brand for €90 million, the new airline will not be adopting its predecessor’s name. The name has most likely been purchased only to prevent competitors from acquiring it.
