What are my rights in the event of a delayed or cancelled HiSky flight?
We understand that not everyone is aware of what our passenger rights are. Let’s break it down. Under EU Regulation (EC) No. 261/2004, commonly known as EU261, passengers flying with EU airlines or departing from the EU may be entitled to compensation. The UK also has an equivalent (UK 261): 'The Air Passenger Rights and Air Travel Organisers' Licensing (Amendment) (EU Exit) Regulations 2019'. This was designed so that travellers going to and from the UK were also protected after Brexit occurred.
What does this mean for your HiSky flight disruption?
- Did you experience a HiSky delay? If your delay to your destination was a minimum of 3 hours, you are probably entitled to flight compensation.
- Did you experience a HiSky flight cancellation? If the flight was cancelled less than 14 days before your departure, you may be entitled to a HiSky cancelled flight compensation. If your flight was unexpectedly cancelled and you did not accept an alternative flight offered by HiSky, you are also eligible for a refund.
- “Right to care” is the special assistance airlines are required to offer in case of a disruption, no matter the cause. This includes: food and beverage vouchers, communication services, and, if necessary, accommodations and transit. To claim these, you have to go directly to the airline’s service desk at the airport. If HiSky refuses to give you a voucher, buy what you need (we recommend keeping the receipts), and they will have to pay you back for your expenses (as long as they can be justified and are within reason).
Note: There are certain circumstances when airlines are not liable for your flight disruption. These are “extraordinary circumstances”. For you to be eligible for compensation, the disruption needs to be solely the airline’s responsibility. However, this does not impact your right to refund, or your “Right to Care”, these can be claimed regardless.
Travelling outside of the UK/EU with HiSky. Can I still get compensation?
This question depends on which subsidiary of the airline you are flying with.
Indeed, HiSky has two subsidiaries: one in Romania, and one in Moldova.
If you are flying with HiSky Europe (based in Romania), you have the same rights as other EU airlines. In this case, all EU and UK 261 laws apply to you, regardless of where you landed or departed from.
On the other hand, if you are flying with HiSky (titular), it is not considered an EU airline, as it is based in Moldova. In this case, only flights departing from EU or UK countries are eligible for compensation and/or refund.

HiSky compensation for a delayed flight
Has your HiSky flight been delayed? Keep reading to find out the conditions of eligibility for compensation. Depending on certain circumstances, you may be eligible for up to 600€ per passenger! Here are the criteria:
- Duration of the delay: The delay must exceed 3 hours.
- Reason for the delay: The cause of the delay must be due to circumstances within the airline’s control.
The delay may have been caused by “extraordinary circumstances” - circumstances that were out of the airline’s control. In these cases, compensation may not be possible.
When can I claim compensation for my cancelled HiSky flight?
Similarly to delays, if your HiSky flight was cancelled, you may be eligible for compensation. There are also certain criteria to meet for eligibility.You may also be eligible for compensation from additional fees that you may have incurred because of the cancellation. Does your HiSky flight meet the following criteria?
- Your flight was cancelled less than 14 days before you were scheduled to depart, AND,
- The cancellation was the airline’s responsibility, and not “extraordinary circumstances”.
Can I claim a refund for my cancelled HiSky flight?
You are eligible for a refund of your HiSky flight if your flight was cancelled, and you did not accept the alternative flight that HiSky offered.
Please note that sometimes you may not be offered an alternative flight at all. In this case, you can, of course, also request a refund from HiSky.
What happens if I cancel my HiSky flight myself? Am I still eligible for compensation?
In most circumstances, if you are the one who decides to cancel your flight, you are not eligible for compensation of your flight under EU and UK 261 regulations. However, always check HiSky’s refund and compensation policies on their website, or reach out to their customer service.
I missed my HiSky connection flight due to a flight disturbance
If both of your flights were booked under the same ticket reservation, and you miss one leg of your flight due to the previous being delayed or cancelled, HiSky must offer you a seat on the next flight. You may also be eligible for compensation and/or a ticket refund under the EU 261 regulations.
What happens if HiSky offers me a voucher? Should I accept?
In some cases, HiSky may offer you a flight voucher instead of a refund. At first glance, this may seem like a good compromise. However, here are a few reasons why you should consider rejecting this offer for a voucher:
- Flight vouchers are usually subject to limitations. These can include blackout dates, expiration dates, or limited destinations. This can make it more difficult to use your voucher according to your needs and preferences.
- Usually, accepting a voucher signifies that you trade your right to a cash refund. If, after accepting this voucher you realise that you will not be travelling, or the voucher does not suit your needs, or HiSky is in financial trouble, you may not be able to trade your voucher for a cash refund.

I’ve experienced a delay with a HiSky flight, how much can I get?
Your total compensation amount depends on the distance of your journey. If you travelled transatlantic with HiSky, your compensation amount will be different than if you travelled domestically within, for example, Romania. Here is a breakdown of the compensation amounts:

What happens if I can’t board a HiSky flight due to overbooking?
If your flight is overbooked and you are refused boarding, you may be entitled to a refund and compensation. HiSky is required to offer you the choice between a full refund of your ticket, or a free re-route to your destination in these situations. If your arrival time is at least 3 hours later than your original arrival time, you are also entitled to compensation by HiSky.
What happens if my flight is disrupted due to extraordinary circumstances?
In some instances, flight disruptions can occur due to circumstances that are beyond the control of the airline. These extraordinary circumstances usually exempt airlines from providing compensation to their passengers, as the situations were not their responsibility.
Examples of extraordinary circumstances that HiSky would use to deny your claim include the following:
- Bad weather conditions, such as thick fog, heavy rain, or thunderstorms.
- A strike, most often specifically within the aviation industry (for example, a strike of air traffic control workers at a specific airport).
If the strike is from the airline’s crew, it is not considered an extraordinary circumstance! - Political circumstances, such as a terrorist attack or general security risk due to political unrest.
- Natural disasters, including volcanic eruptions and hurricanes.
- A collision between the aircraft and birds or other foreign objects.
- An ill or unruly passenger.
- Flight delays caused by the airport staff, such as extraordinarily long queues to security checks.

HiSky is a Moldovan airline established in 2019. It specialises in low-cost flights, mainly within Europe, but with certain flights travelling trans-atlantic.
